Why not these arguments are not applied in the case of Phukan?

George Fernandes threatened to move the court against the UPA government if it did not lay the Phukan Commission report in the parliament. Govt. tabled the report but after killing it. The Phukan Commission, which probed defence purchases during the Kargil war, has found irregularities in 13 of the 15 purchases. The commission gave a clean chit to former Defence Minister George Fernandes in its interim report.

Defence Minister Pranab Mukherji who has been in the eye of a storm ever since his Ministry filed an affidavit which too had given Fernandes a clean chit. At that time, Mukherji had reportedly offered to resign, owning responsibility for the affidavit which was later followed up by a second affidavit to the Supreme Court. But the Prime Minister had refused to accept Mukherji’s offer. The Cabinet Committee should have discussed Defence Ministry’s affidavit submitted in SC on Political Affairs, but in their eyes there is no need to discuss Phukan Commission report in Parliament. So I say this is Pseudo-parliament.

First it was Banerjee commission and its interim report specially leaked to Lalu before submission to Govt. Now Saptarishi, a IAS officer, being a sinner is trying to wash the sins of Lalu. Lalu demanded the resignation of two ECs—B B Tandon (who will take over as Chief Election Commissioner on June 16) and N. Gopalaswami—on the basis of said non-exit letter
Saptarishi held press conference in IIC, New Delhi without permission of the authority of IIC. He forced to abandon press meet. These notorious IAS & Ministers are doing all these frauds openly. Media also takes it lightly.

At present, there are two Election Commissioners with one Chief Election Commissioner, appointed by the President. Chief Election Commissioner can be removed from office only by parliamentary impeachment. The Commission decides most matters by consensus but in case of any dissension, the majority view prevails. Chief Election Commissioner said that decision regarding Chhapra had been taken unanimously.

The only change one sees from the earlier system is that a so-called “Eminent Persons’ Group (EPG)” has replaced the titular “senior” officer (i.e., “controlling officer” or “immediate superior”. If Dr. Singh’s proposal will be followed blindly then who would bother their seniors. The selection of an enforcement ethics entails three essential issues:
Who is to monitor and investigate the conduct of legislators, ministers and officials?
Which sanctions are to be imposed?
Who is to impose those sanctions?

For legislators: the options include a committee of the legislature, a parliamentary official, an independent officer or commission, and a combination of these.
The option of above may be the President of India or Supreme Court or a committee appointed by SC on the approval of Rastrapati. The agency must have the capacity to perform and be seen as performing its monitoring role objectively and fairly.

Which sanctions are to be imposed?
For this purpose whatever procedure be adopted, ultimately voters should be final authority. At least for elected members, the ballot box remains the ultimate sanction if no other sanction applies or is imposed. Voters should have right to recall their previously elected member.
Who is to impose those sanctions?
For legislators, one option is to leave judgement and sentence to the electorate at the ballot box. But as Professor Thompson has noted, this means that in single member electorates the people as a whole are given no role. According to Professor Thompson, this ignores the "interdependency of legislators" , noting also that "[c]redibility is important not simply for making ethical standards effective; it is also necessary for making them valid."
The remaining options for legislators include: self-regulation by the legislature or the house to which the legislator belongs, or enforcement by the monitoring authority or the courts.

"The people" speak through the "loyal opposition " as well as the government, through backbenchers as well as Cabinet ministers. There is simply no substitute for the "checks and balances" which are brought into play in the representative and watchdog functions performed by ordinary Members o parliament.

If parliament is to be preserved, as a living institution the opposition must fearlessly perform its functions. If the opposition is wiped out and the UPA will be able to do as they please and there will be no one to be your voice and relentlessly pursue your concerns in parliament. Are you prepared to accept mock debates and shows of UPA and Left? Or do you want an opposition that is not tied and obligated to the party in government? Your decision will make the difference.

Why do they conduct elections? They can ask President and Governors to declare who should rule the state! LJP - Congress combined and Left arties fought Bihar Assembly Election against Lalu’s RJD. It upholds and maintains the rights of minorities against majorities. It must be vigilant against oppression and unjust invasions by the Cabinet of the rights of the people. It finds fault; it suggests amendments; it asks questions and elicits information; it arouses, educates and molds public opinion by voice and vote. It must scrutinize every action by the government and in doing so prevents the short cuts through democratic procedure that governments like to make.

While nobody should have any objection to such a development in a secular country, what every secularist must object to is the fact that, while the Muslim population is rising alarmingly due to illegal influx from Bangladesh, the Christian population is rising due to conversion, both forced and induced, of mostly the gullible Hindus who do not have any means to defend themselves. Almost 19 districts in three Border States of Assam, West Bengal and Bihar have recorded a "disproportionate" growth of Muslims over past one decade. The National Commission for Minorities (NCM) in a report here claimed that the 10 districts of Assam bordering Bangladesh have now substantive Muslim population as high as 51 per cent. The Commission had set up a four-member expert panel of eminent demographers to analyse the 2001 census statistics of religious minorities including Muslims. The panel reported that the intercensal growth of Muslim population during 1991-2001 was 29.5 per cent, higher than the overall growth rate of 21.5 per cent.
"Either this type of growth is due to large number of conversions or due to migration of population from across Bangladesh," Country's leading demographer Prof. Ashis Bose stated.

Christian Congress governments of North-East India are openly telling the Non-Christians that "this is a Christian State and that Non-Christians have no business or domicile here. Either they get converted or they will be eliminated or kicked out."

Christians are using immoral means to convert Hindus into Christianity. Sari wearing nuns enter poor villages with food, clothing and money. The rest is history. People should fight whichever way possible against to counter it.
